REQUIRED NOTICE TO INSURANCE CLAIMANTS FOR MOTOR VEHICLE REPAIRS

BY LAW, YOU HAVE THE RIGHT TO SELECT WHERE YOUR MOTOR VEHICLE IS

REPAIRED AND THE PARTS USED FOR REPAIRS. HOWEVER, AN INSURANCE COMPANY

IS NOT REQUIRED TO PAY MORE THAN A REASONABLE AMOUNT FOR SUCH REPAIRS

AND PARTS. YOUR STATUTORY RIGHTS REGARDING MOTOR VEHICLE REPAIRS ARE

EXPLAINED IN THE COPY OF THE INSURANCE CODE, ARTICLE 5.07-1, PRINTED ON THE

REVERSE SIDE OF THIS NOTICE OR ATTACHED TO THIS NOTICE. IF THE DAMAGE TO

YOUR VEHICLE IS COVERED BY AN INSURANCE POLICY, THE NATURE OF THE

COVERAGE AND YOUR LEGAL RIGHTS UNDER THE CONTRACT ARE DESCRIBED IN

MORE DETAIL IN THE APPLICABLE POLICY. [IF YOU ARE INSURED BY THE COMPANY

insurance company recommends a specific one. This right is protected by Texas law, which

prevents insurance companies from forcing customers to use a particular repair facility. Drivers

can select any shop they trust and inform their insurance provider of their choice.

● Freedom of Choice: Texas law ensures drivers are not restricted to using a specific

repair shop recommended by their insurance company.

● Informed Decision: While insurance companies may recommend a shop, drivers can

choose a different one and inform their insurer.

● Reasonable Costs: Insurance companies are not obligated to pay more than a

reasonable amount for repairs, regardless of the chosen shop.

● Steering is Prohibited: Insurance companies cannot pressure or steer customers

towards specific repair shops.

● Transparency: Drivers have the right to receive a written estimate before repairs begin

and should be informed of any additional necessary repairs.

● Quality Workmanship: Drivers are entitled to expect quality workmanship and can

question the repair process if needed.

No. An insurance company may give you a list of their “preferred” shops, but by state law you can take your vehicle to the shop of your choice.

An estimated time frame can be provided once an estimate of repair costs is done; however, there are factors that may delay repairs, such as additional damage not visible at time of estimate, delay of parts delivery, inability to find proper parts, etc.

You need to be sure to coordinate rental vehicle coverage before you bring your vehicle for repair.
